RightNow Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RightNow mobile application, website, and related services (collectively, the "Service"), operated by Pajoco Enterprises, LLC ("Pajoco," "we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service.

By using the Service, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law

2. Account Registration

To use certain features, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Be responsible for all activity under your account

You are responsible for any activity that occurs through your account, whether or not authorized by you.

3. User Content

A. Content You Provide

The Service allows you to create, upload, and share content, including photos, videos, messages, prompts, stories, text, and other materials ("User Content").

You retain ownership of your User Content.

By posting User Content, you grant Pajoco a non-exclusive, royalty-free, worldwide license to host, store, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, improving, and providing the Service.

B. Responsibility for User Content

You are solely responsible for your User Content and the consequences of sharing it.

You represent and warrant that:

• You have the rights necessary to share the content
• Your content does not violate these Terms or applicable law

Pajoco does not endorse and is not responsible for User Content posted by users.

4. Content Visibility & Sharing

The Service provides multiple visibility options, including public, friends-only, and direct or group sharing.

You acknowledge that:

• Other users may take screenshots or screen recordings
• The Service may notify users of screen capture activity where supported
• Pajoco cannot prevent all forms of copying or sharing outside the Service

5. Prohibited Conduct

You agree not to:

• Violate any applicable law or regulation
• Harass, abuse, threaten, or harm others
• Post content that is illegal, defamatory, obscene, or hateful
• Impersonate another person or entity
• Attempt to access accounts or data without authorization
• Reverse engineer or interfere with the Service
• Use the Service for commercial purposes without permission
• Create or operate automated accounts, bots, or scripts to interact with the Service
• Engage in coordinated inauthentic behavior, including using multiple accounts to artificially amplify content
• Manipulate follow counts, engagement metrics, or content visibility through automated or deceptive means
• Scrape, crawl, or systematically collect data from the Service without express written permission
• Create fake or impersonator accounts, or misrepresent your identity or affiliation
• Send unsolicited messages in bulk or flood content feeds with repetitive or automated content

Pajoco reserves the right to determine what constitutes prohibited conduct.

6. Moderation & Enforcement

We may, but are not required to:

• Review User Content
• Remove or restrict access to content
• Suspend or terminate accounts

We may take these actions at any time, with or without notice, to enforce these Terms or protect users and the Service.

We use automated systems to detect policy violations including bot activity, spam, and coordinated inauthentic behavior. Accounts flagged by these systems may be subject to immediate restrictions or permanent removal without prior notice. You may request human review of any automated enforcement action by contacting support@pajoco.com.

7. Messaging & Encryption

Messages are transmitted securely, and some conversations may support end-to-end encryption.

You acknowledge that:

• No system is completely secure
• Pajoco cannot guarantee absolute confidentiality
• We do not guarantee delivery or retention of messages

8. Disappearing & Temporary Content

Some content (such as Stories or disappearing messages) may automatically expire or be deleted.

You understand that:

• Expired content may not be recoverable
• Users may still capture content before expiration

9. Intellectual Property

The Service, including its software, design, graphics, trademarks, and branding, is owned by Pajoco Enterprises, LLC and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our permission.

10. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• You violate these Terms
• Your use poses a risk to other users or the Service
• We are required to do so by law

Upon termination, your right to use the Service ends immediately.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PAJOCO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED
• WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE
• WE DO NOT GUARANTEE THAT CONTENT WILL BE ACCURATE OR SAFE

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PAJOCO ENTERPRISES, LLC SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF DATA, PROFITS, OR GOODWILL
• USER CONTENT OR USER CONDUCT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE (IF ANY) IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify and hold harmless Pajoco Enterprises, LLC and its members, officers, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time.

If changes are material, we will provide reasonable notice. Continued use of the Service after changes constitutes acceptance.

15. Governing Law & Venue

These Terms are governed by the laws of the State of [Insert State], without regard to conflict-of-laws principles.

Any disputes shall be resolved exclusively in the state or federal courts located in that state.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
